When ordering a website from with Roslin Design the following terms and conditions listed on this page are applicable.
The Client: The company or individual requesting the services of Roslin Design.
Roslin Design: Primary designer/site owner & employees or affiliates
Roslin Design will carry out work where an agreement is provided by either email, telephone or in person. An ‘order’ is deemed to be a written or verbal contract between Roslin Design and the client, this includes telephone and email agreements.
Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors, Roslin Design cannot accept responsibility for any losses incurred due to program malfunction, the website or any part of it.
The website, graphics and any programming code remain the property of Roslin Design or their respective copyright holders.
Any scripts, cgi applications, php scripts, or software (unless specifically agreed) written by Roslin Design remain the copyright of Roslin Design or their respective copyright holders and may only be commercially reproduced or resold with the permission of Roslin Design.
Roslin Design cannot take responsibility for any copyright infringements caused by materials submitted by the client or otherwise. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.
Entry-level website design package includes the following:
1. A high quality professionally themed WordPress website
2. Free website hosting for 1 year (currently worth £8.25+VAT per month assuming annual plan and subject to the Web Hosting Service Agreement)
3. A domain name registered for 1 year up to a maximum value equivalent to £10.99+VAT.
4. Access will be provided to clients for the WordPress content management system
5. Amends to be received within 30 days of draft website.
6. 4 hours free amendment time will be provided for amends to the website, before the website goes live on the internet.
7. Up to 10 web pages designed.
E-commerce website design package includes the following:
1. A high quality professionally themed OpenCart or Magento website
2. Free website hosting for 1 year (currently worth £7.99 per month assuming annual plan and subject to the Web Hosting Service Agreement)
3. A domain name registered for 1 year up to a maximum value equivalent to £10.99+VAT.
4. Access will be provided to clients for the OpenCart or Magento content management system
5. Amends to be received within 30 days of draft website.
6. 4 hours free amendment time will be provided for amends to the website, before the website goes live on the internet.
7 Information for 10 products will be inserted into the website for free. Information is to be provided by the client.
8. Up to 10 web pages designed.
Any additions to the brief will be carried out at the discretion of Roslin Design and where no charge is made by Roslin Design for such additions, Roslin Design accept no responsibility to ensure such additions are error free and reserve the right to charge an according amount for any correction to these or further additions.
The client agrees to make available as soon as is reasonably possible to Roslin Design all materials required to complete the site to the agreed standard and within the set deadline.
Roslin Design will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.
Roslin Design will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner.
Roslin Design will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client or any of the clients appointed agents.
Roslin Design will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.
Once a website has been designed and completed the final balance of payment is then due in accordance with our payment terms.
Roslin Design cannot take responsibility for any losses incurred by the use of any software created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.
The client is expected to test fully any application or programming relating to a site developed by Roslin Design before being made generally available for use. Where “bugs”, errors or other issues are found after the site is live, Roslin Design will endeavour (but is not obliged to) to correct these issues to meet the standards of function outlined in the brief.
By employing Roslin Design to design and build an eCommerce website you are agreeing to have your website hosted with Roslin Design.
Roslin Design will endeavour to ensure that any developed/designed site or application will function correctly on the server when it is initially installed and that it will function correctly when viewed with the web browsing software to an acceptable level with the past 2 versions of Internet Explorer, Google Chrome and Firefox browsers. Roslin Design can offer no guarantees of correct function with all browser software.
Whilst Roslin Design provides website hosting services, no guarantees can be made as to the availability or interruption of this service. Roslin Design cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.
Roslin Design reserves the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial, and also to terminate the hosting service should the necessity arise.
The Web Hosting Service Agreement is applicable to all websites hosted with Roslin Design.
It is the Roslin Design policy that any outstanding accounts for work carried out by Roslin Design or its affiliates are required to be paid in full, no later than 30 days from the date of the invoice unless by prior arrangement with Roslin Design.
Once work is completed you are obliged to pay the balance of payment in full. We will contact clients via email and telephone to remind them of such payments if they are not received when due.
If accounts are not settled or Roslin Design have not been contacted regarding the delay, access to the related website may be denied and web pages removed, we will then pass such cases to the Small Claims Court to pursue payment.
Following consistent non payment of an invoice our Solicitors will contact the client in question, with a view to taking the matter further and if need be to seek payment through legal procedures, and if necessary court summons.
Although we do not guarantee compatibility on any device or browser, we strive to build our websites to be compatible with the most common modern browsers including the latest versions of Firefox, Google Chrome, and Internet Explorer version 8 and above. We also test our themes on various mobile, tablet, and desktop devices. Any device or browser specific problems should be reported to [email protected]
Anyone who experiences a problem with their web service should raise the matter directly using our online contact form to do so, giving sufficient information to locate the material (such as an url) and clearly outlining the grounds for complaint.
Roslin Design will approach the individual responsible for the material in question with a view to resolving the matter to the satisfaction of the complainant.
Here we outline how quickly we would normally expect to complete a piece of work. While we usually complete outstanding work well within these times, we offer no guarantee that we will be able to do so.
If you have a piece of work that needs completed by a specific date or time, please let us know and we will endeavour to complete it by the requested deadline.
Should there be a technical problem with your site, email account or domain, we will always treat it as our top priority. We will always attempt to resolve the problem as quickly as possible and get your services back up and running as they should be.
Should you request an update to your website that will take us less than 1 hour to complete, we will normally complete the update within 2 working days.
Should you request an update to your website that will take us between 1 and 3 hours to complete, we will normally complete the update within 5 working days.
Should you request an update to your website that will take us up to a full working day to complete hours to complete, we will normally complete the update within 10 working days.
If you have a bigger piece of work that needs completing, how long it can take will depend on the size of the job, the complexity of the work, and possibly a number of other factors. Normally however we would expect to complete most jobs within 20 to 30 working days. For larger piece of work, please ask us how long it will take for an accurate estimate.
Currently a website redesign is normally expected to be completed within 20 to 30 working days.
Should you need the work completed urgently by a deadline that allows less time than we would normally require for that particular amend, we normally charge an extra % additional fee for the work.
Should you need us to immediately start work on your project or design updates and complete the work as quickly as possible, we normally charge an extra 50% additional fee for the work. Should you require us to work over a weekend, or outwith normal working hours to complete your project within the required deadline, we normally charge a 100% additional fee.
Urgent, emergency and out of hours work will only be accepted at our discretion. We will inform you before agreeing to start this type of work what our rate for the work will need to be to complete the work within the required deadline.
Please note that all expected completion times are measured from the time at which we receive all the material required to complete the work.
This material may include text, imagery, video, or any other information needed to complete the job, such as questionnaire responses, answers to queries, access to hosting, etc. If we haven’t received all the information we have requested, we will not start work on the project.
